1. Definitions

For the purposes of these Terms and Conditions (“Terms”), the following definitions shall apply unless the context otherwise requires. Words in the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.

  • “Agent” means GP Travel Services Limited trading as GoPinoy Travel (“we”, “us”, “our”) and includes its employees, directors, agents, contractors, subcontractors, affiliates, successors, and assigns.

  • “Booking” means a confirmed reservation made through GoPinoy Travel for Travel Services with a Principal.

  • “Consumer” means an individual who obtains Travel Services for personal use, not related to business.

  • “Contract of Carriage” means the contract between you and a Principal (such as an airline) governing the carriage of passengers or goods.

  • “Force Majeure” means any event or circumstance beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, government restrictions, terrorism, or technological failures.

  • “Principal(s)” means any third-party travel service provider whose products or services are booked through GoPinoy Travel, including airlines, hotels, car rental companies, tour operators, cruise lines, and insurers.

  • “Travel Services” means any travel-related product or service booked through GoPinoy Travel, including but not limited to flights, accommodation, tours, transfers, vehicle hire, insurance, and ancillary services.

  • “User” means any person accessing the Website or using the services provided by GoPinoy Travel.

  • “Website” means the official GoPinoy Travel website and all associated digital platforms or online booking systems.

2. Scope and Application of These Terms

2.1 Application of Terms
These Terms apply to all contracts, bookings, transactions, communications, and dealings between you and GoPinoy Travel, whether online, by phone, email, or otherwise, relating to Travel Services.

2.2 Acceptance of Terms
By making a booking or otherwise engaging our services, you confirm that you have read, understood, and accepted these Terms on behalf of all travellers included in your Booking.

2.3 Entire Agreement
These Terms, together with any written agreements, booking confirmations, and Principal terms and conditions, constitute the entire agreement between you and GoPinoy Travel. They supersede all prior negotiations, representations, or understandings.

2.4 Electronic Communication
All communications, including booking confirmations, notices, or consents, may be provided electronically, and you consent to this form of communication.

2.5 Third-Party Rights
These Terms do not confer rights on any third party except as expressly stated or as permitted under applicable law.

2.6 Amendments
GoPinoy Travel reserves the right to amend these Terms at any time without prior notice. Updated Terms will be posted on our Website, and continued use of our services constitutes acceptance.

3. Our Role and Relationship with Principals

3.1 Agency Role
GoPinoy Travel operates solely as an agent facilitating bookings between you and Principals. We do not provide Travel Services directly.

3.2 Principal Contract
Your contract for Travel Services is with the relevant Principal(s), governed by their terms and conditions, which may differ from these Terms.

3.3 No Ownership or Control
We do not own, operate, or control any services or facilities offered by Principals, and we disclaim all liability arising from their performance, quality, safety, or availability.

3.4 Selection of Principals
We exercise reasonable skill and care in selecting Principals, but do not guarantee their solvency, reliability, or compliance with applicable laws or standards.

3.5 Subcontractors and Affiliates
Where we engage subcontractors or affiliates to perform any services, these Terms apply equally, and we remain responsible for their acts or omissions as permitted by law.

3.6 Travel Advice and Recommendations
Any travel advice, recommendations, or information provided by us are general in nature and do not constitute professional advice. You should independently verify all travel requirements and suitability.

4. Booking Process and Contractual Relationships

4.1 Booking Submission
You may make bookings via our Website, phone, or email. When you submit a booking request, it is subject to availability and acceptance by the relevant Principal.

4.2 Confirmation of Booking
A Booking is confirmed once we receive full payment or deposit (as specified), and the Principal confirms the reservation. Until confirmation, bookings are subject to availability and may be cancelled.

4.3 Multiple Passengers and Group Bookings
If your Booking includes multiple travellers, you represent that you have authority to accept these Terms on behalf of all travellers. Group bookings may be subject to additional terms.

4.4 Contract Formation
Your contract for Travel Services is directly with Principals. GoPinoy Travel is not a party to such contracts and only facilitates the booking.

4.5 Accuracy of Information
You must ensure all details provided at booking are accurate, including names, dates of birth, and passport details. Errors may lead to denied boarding or entry and incur amendment fees.

4.6 Special Requests
Any special requests (e.g., dietary, accessibility) must be clearly communicated at booking but cannot be guaranteed. Principals may accept or reject such requests.

4.7 Changes and Cancellations by You
Requests for changes or cancellations must be made in writing and are subject to Principal policies and applicable fees.

4.8 Travel Insurance
We strongly recommend obtaining comprehensive travel insurance covering cancellations, medical emergencies, and other risks.

5. Disclosure of Commissions and Fees

5.1 Commission and Remuneration
GoPinoy Travel may receive commissions, fees, overrides, or other remuneration from Principals or third parties in connection with bookings made through us. This remuneration is retained by us and does not reduce the price payable by you unless expressly stated.

5.2 Transparency
We operate in compliance with all applicable laws and industry standards requiring transparency. On request, we will disclose details of commissions or fees related to your Booking.

5.3 Service Fees
In addition to Principal charges, we may impose service fees, booking fees, amendment fees, or cancellation fees as disclosed at the time of booking or in our Fee Schedule. All fees are non-refundable unless otherwise stated.

5.4 No Bribery or Undue Influence
GoPinoy Travel strictly prohibits any form of bribery or undue influence in securing commissions or business, complying fully with the New Zealand Anti-Bribery and Corruption laws.

5.5 Payment of Fees
All fees, including commissions, fees payable to Principals, and charges by GoPinoy Travel, must be paid in accordance with the payment terms set out in these Terms.

6. Information Accuracy and Your Responsibilities

6.1 Information Provided
GoPinoy Travel endeavours to provide accurate, current information based on data supplied by Principals and public sources. However, we do not independently verify all information and accept no liability for inaccuracies or omissions.

6.2 Verification Obligations
You must verify all travel details, including itinerary, pricing, travel dates, names, passport details, visa requirements, health and vaccination information, and applicable laws before travel.

6.3 Changes by Principals or Authorities
Travel information is subject to change due to Principal decisions or government regulations. We are not liable for any changes, delays, or cancellations outside our control.

6.4 Your Representations
By proceeding with a booking, you warrant that all information provided to us is truthful, accurate, and complete. Failure to provide accurate information may result in denied services or cancellation without refund.

6.5 Consequences of Incorrect Information
If incorrect information results in additional costs, denied boarding, entry refusal, or other penalties, you accept full responsibility for such consequences, including payment of associated fees or charges.

7. Bookings and Amendments

7.1 Service Fees
Any assistance you require from us in helping you find suitable flights, accommodation, tours and travel insurance may incur fees payable to GoPinoy Travel. Our service fees are as follows (subject to change):

  • Domestic Flights: NZD 50 per passenger per ticket

  • International Flights: NZD 100 per passenger per ticket

  • Accommodation: NZD 100 per reservation

  • Other Services: As advised at the time of request

7.2 Requests for Changes
Any request to amend a Booking must be submitted in writing to GoPinoy Travel. Approval is subject to availability and Principal policies.

7.3 Amendment Fees
Amendments may incur fees payable to both GoPinoy Travel and Principals. Our amendment fees are as follows (subject to change):

  • Domestic Flights: NZD 100 per passenger per ticket

  • International Flights: NZD 150 per passenger per ticket

  • Accommodation: NZD 150 per Booking

  • Other Services: As advised at the time of amendment request

7.4 Timing of Amendments
Certain amendments may not be possible or may incur higher fees if requested close to departure dates. Amendments requested within 48 hours of travel are generally restricted.

7.5 Name Changes
Name changes after booking are generally not permitted by Principals. Any approved name changes will attract fees and possible reissue costs.

7.6 Itinerary Changes
Changes to travel dates, routes, or accommodation are subject to Principal approval and associated fees. We cannot guarantee alternative arrangements will be identical or available.

7.7 Denial of Amendment
We reserve the right to refuse any amendment request where Principals decline or where it would violate regulations or terms.

7.8 Effect of Amendments
Once confirmed, amended Bookings are subject to the same Terms as original Bookings.

8. Cancellations and Refunds

8.1 Cancellation by You
Cancellations must be made in writing to GoPinoy Travel. Verbal or informal notices are not accepted.

8.2 Cancellation Fees
Cancellation fees will apply according to Principal policies and GoPinoy Travel’s fees. Fees vary by service type, fare conditions, and timing of cancellation.

8.3 Refund Processing
Refunds are processed only after receipt of refund funds from Principals. Processing times may vary, and GoPinoy Travel is not responsible for delays by Principals.

8.4 Non-Refundable Amounts
Certain fees, such as booking fees, commissions, and non-refundable deposits, will not be refunded.

8.5 Partial Use
No refunds are payable for unused or partially used services unless specified by Principals.

8.6 Force Majeure Cancellations
If cancellation results from Force Majeure, we will assist in obtaining refunds or credits from Principals but are not obligated to provide compensation.

8.7 Travel Insurance Claims
Travel insurance claims for cancellations are your responsibility. GoPinoy Travel does not guarantee refund eligibility.

9. Prices, Taxes, and Currency

9.1 Currency
Unless expressly stated otherwise, all prices, fees, and charges are quoted and payable in New Zealand Dollars (NZD).

9.2 Price Variations
All prices are subject to change without prior notice until full payment is received. Price changes may result from factors beyond our control, including currency fluctuations, changes in taxes, fees, surcharges, or fuel costs imposed by Principals or authorities.

9.3 Taxes, Fees, and Levies
You are responsible for all applicable taxes, government-imposed fees, airport charges, security fees, customs duties, levies, and other governmental charges related to your Travel Services. These may be included in the price or payable separately.

9.4 New or Increased Taxes
If new taxes or fees are introduced or increased after full payment, you remain responsible for paying these charges before travel.

9.5 Price Quotes
Price quotations provided by GoPinoy Travel are valid for a limited period as specified. Bookings must be confirmed within this period to secure quoted prices.

9.6 Errors and Omissions
GoPinoy Travel reserves the right to correct any errors, omissions, or inaccuracies in pricing at any time and to cancel or amend bookings affected by such errors.

10. Payment Terms and Security

10.1 Payment Methods
We accept payment via credit/debit cards, POLi, bank transfer, and other payment gateways as specified at booking.

10.2 Payment Timing
Full payment or a required deposit must be made by the due date specified in your booking confirmation or invoice.

10.3 Payment Gateways and Third Parties
Payments processed through third-party gateways (e.g., POLi, Stripe) are subject to their terms and security policies. GoPinoy Travel is not responsible for payment gateway errors, delays, or fraud.

10.4 Payment Declined or Reversed
If your payment is declined, reversed, or otherwise not received, your Booking may be automatically cancelled without notice and fees may be forfeited.

10.5 Fraud Prevention
We reserve the right to verify payment details and may require additional identification or documentation before accepting payment to prevent fraud.

10.6 Late Payment
Failure to pay by the specified date may result in cancellation of your Booking and loss of deposits or fees.

10.7 Refunds and Chargebacks
Refunds will be processed in accordance with these Terms. Initiating chargebacks or disputes with your bank without first contacting us may breach these Terms and result in immediate cancellation.

11. Travel Documentation, Passports, and Visas

11.1 Traveller Responsibility
You are solely responsible for ensuring that all travellers possess valid passports, visas, permits, or other travel documentation required for entry to, transit through, or exit from all countries on your itinerary.

11.2 Validity Requirements
Passports must have a minimum validity period, typically six months beyond your intended return date, unless otherwise specified by authorities.

11.3 Visa Application Assistance
If you request, GoPinoy Travel may provide administrative assistance with visa applications based on information you provide. This assistance does not guarantee visa approval.

11.4 Visa and Entry Requirements
You acknowledge that visa and immigration requirements vary and may change without notice. It is your responsibility to monitor and comply with these requirements.

11.5 Denied Entry or Boarding
If you or any traveller is denied entry or boarding due to failure to hold valid documentation, you acknowledge that GoPinoy Travel is not liable for any resulting costs, losses, or delays.

11.6 Document Accuracy
You must ensure all personal details provided for ticketing and documentation match exactly with travel documents. Discrepancies may result in refusal by Principals or authorities.

11.7 Customs and Quarantine Regulations
You must comply with all customs, quarantine, and biosecurity laws of countries visited. Failure to do so may result in penalties or denial of entry.

12. Health, Medical and Insurance Requirements

12.1 Health Requirements
Certain destinations and Travel Services require specific vaccinations, medical tests, or health declarations. You are responsible for meeting these requirements.

12.2 Pre-Existing Conditions
You must disclose any pre-existing medical conditions to your insurer. Failure to do so may invalidate insurance coverage.

12.3 Medical Fitness
You warrant that you are medically fit to travel and participate in all booked activities. Certain travel (e.g., cruises, high-altitude tours) may pose health risks.

12.4 Travel Insurance
GoPinoy Travel strongly recommends that you obtain comprehensive travel insurance that includes coverage for medical emergencies, trip cancellation, loss or theft of belongings, and other risks.

12.5 Limitations on Liability for Health Issues
We are not responsible for any health-related issues, medical expenses, or inability to travel due to medical conditions or failure to comply with health requirements.

12.6 Communicable Diseases
You must not travel if you have or suspect you have any communicable disease that may pose a risk to others or contravene government health regulations.

12.7 COVID-19 and Other Epidemics
You acknowledge that COVID-19 and other epidemics may affect travel arrangements, including quarantine requirements, testing, or travel bans. We are not liable for costs or disruptions related to such events.

13. Force Majeure and Unforeseeable Events

13.1 Definition of Force Majeure
For the purposes of these Terms, “Force Majeure” refers to any event, circumstance, or cause beyond the reasonable control of GoPinoy Travel or Principals, including but not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, tsunamis, volcanic eruptions, wildfires)

  • Epidemics, pandemics, or public health emergencies (including COVID-19)

  • Government acts, regulations, restrictions, or embargoes

  • Acts of terrorism, war, riots, civil unrest, strikes, or labour disputes

  • Technical failures including computer system failures, internet outages, or telecommunication disruptions

  • Cancellation or alteration of flights or other transport services by Principals

13.2 Effect on Bookings
If a Force Majeure event prevents, hinders, or delays the fulfilment of your Booking, we and Principals shall be released from our obligations to the extent affected. This may include cancellation, rescheduling, or modification of Travel Services.

13.3 Our Obligations
Where possible, GoPinoy Travel will assist you in obtaining refunds, credits, or alternative arrangements from Principals but does not guarantee success or compensation beyond what Principals provide.

13.4 No Liability
Neither GoPinoy Travel nor Principals shall be liable for any loss, damage, or inconvenience arising from Force Majeure events.

13.5 Your Responsibilities
You acknowledge that Force Majeure events may lead to additional costs, travel delays, or changes and agree to accept such risks as inherent to travel.

14. Limitation of Liability

14.1 Extent of Liability
To the fullest extent permitted by New Zealand law, GoPinoy Travel’s total liability arising out of or in connection with any Booking or these Terms shall be limited to the amount you paid to us for the affected Travel Services.

14.2 Exclusions
We exclude liability for:

  • Any indirect, consequential, incidental, special, or punitive damages

  • Loss of profits, business, goodwill, or anticipated savings

  • Acts, omissions, defaults, or negligence of Principals or third parties

  • Events constituting Force Majeure

  • Any personal injury, death, or property loss or damage, except where caused by our gross negligence or wilful misconduct

14.3 Consumer Guarantees
Nothing in these Terms excludes or restricts any guarantees or rights that you have under the Consumer Guarantees Act 1993 or other applicable laws which cannot be lawfully excluded.

14.4 Indemnity
You agree to indemnify and hold harmless GoPinoy Travel from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of our services.

15. Privacy and Data Protection

15.1 Collection and Use of Personal Information
GoPinoy Travel collects, stores, and processes personal information necessary to provide travel booking services and comply with legal obligations. This includes information you provide during booking, payment, and communications.

15.2 Compliance with Privacy Laws
We comply with the New Zealand Privacy Act 2020 and other applicable privacy laws in protecting your personal information.

15.3 Purpose of Use
Your information may be used for:

  • Processing bookings and payments

  • Communicating travel updates or offers

  • Meeting regulatory requirements such as customs, immigration, and security checks

  • Internal business purposes, including audits and marketing (with your consent)

15.4 Third-Party Disclosure
We may disclose your information to Principals, service providers, government authorities, or law enforcement agencies as necessary for travel arrangements or as required by law.

15.5 Data Security
We take reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or misuse.

15.6 Your Rights
You have the right to access, correct, or request deletion of your personal information, subject to legal obligations.

15.7 Cookies and Tracking
Our Website uses cookies and similar technologies to enhance user experience. Details are outlined in our Privacy Policy.

16. Intellectual Property

16.1 Ownership
All intellectual property rights in content, trademarks, logos, and materials on the Website and in communications remain the property of GoPinoy Travel or its licensors.

16.2 Use of Content
You may use Website content for personal, non-commercial purposes only. Any reproduction, distribution, modification, or commercial use is prohibited without prior written consent.

16.3 User Content
If you submit content (such as reviews or feedback), you grant GoPinoy Travel a non-exclusive, royalty-free license to use, reproduce, and publish such content in any medium.

17. Complaints and Dispute Resolution

17.1 Complaints Process
If you have a complaint about our services, please contact us promptly via info@gopinoytravel.com. We aim to resolve complaints fairly and promptly.

17.2 Escalation
If unresolved, disputes may be referred to the New Zealand Disputes Tribunal or other appropriate consumer dispute resolution bodies.

17.3 No Waiver of Legal Rights
Using these dispute resolution options does not waive any legal rights you may have under New Zealand law.

18. Governing Law and Jurisdiction

18.1 These Terms and your use of GoPinoy Travel services are governed by and construed in accordance with the laws of New Zealand.

18.2 You agree to submit to the exclusive jurisdiction of New Zealand courts in respect of any disputes arising out of or relating to these Terms.

19. Miscellaneous Provisions

19.1 Severability
If any provision is held invalid or unenforceable, the remainder of these Terms remain in full force and effect.

19.2 Waiver
No failure or delay by GoPinoy Travel in exercising any right shall constitute a waiver of that right unless expressly stated in writing.

19.3 Assignment
GoPinoy Travel may assign or subcontract its rights or obligations under these Terms without your consent.

19.4 Force Majeure
Refer to section 13 for Force Majeure provisions.

20. Acceptance of Terms

20.1 By making a booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms on behalf of yourself and all travellers in your Booking.

20.2 If you do not agree to these Terms, you must not make a Booking or use our services.
